Unjust Enrichment
Unjust enrichment claims are often based on an implied contractual relationship for business transactions that do not have an explicit contract. When one party has provided a valuable service or product to another, and the other party accepts and benefits from it, then the receiving party is obligated to provide compensation for the product or service. When no compensation is given, the party providing the product or service may have grounds for an unjust enrichment case and seek restitution. Additionally, unjust enrichment cases may address circumstances for restitution where a party’s performance surpasses the specific requirements of an agreement.
